These Terms and Conditions apply to all purchases and use of the website operated under the Mutineer At Work brand.

By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.

1. Who we are

  • Brand: Mutineer At Work

    Belgium

We sell non‑food consumer products within the European Union and make reasonable efforts to comply with applicable EU laws, including product safety and data protection rules.

2. Scope of these terms

These Terms and Conditions describe the contract between you and Borderstride Morrow when you place an order on our website. They govern ordering, payment, delivery, returns, liabilities, and other rights and duties.

By placing an order you confirm that you have read, understood, and accepted these terms.

3. Ordering and contract formation

  1. Placing an order
You select products, provide necessary details, and confirm payment. We will send an order confirmation by email. This confirmation is not yet a contract.
  2. Contract is formed
A contract is formed when we confirm that the order is accepted and will be fulfilled. If we cannot accept the order, we will notify you and cancel the order without charge.
  3. Data accuracy
You are responsible for providing accurate billing, shipping, and contact information. If you provide incorrect information that delays or prevents delivery, you may be responsible for any extra costs.

4. Prices and payment

  1. Prices are shown on the website in the currency displayed at checkout. They include applicable taxes, unless indicated otherwise.
  2. Payment methods
We accept payment methods shown at checkout. Payment is processed when you confirm the order. We may refuse or cancel an order if a payment fails or appears fraudulent.
  3. Price changes
We reserve the right to change prices at any time, but changes will not affect confirmed orders.

5. Delivery and shipping

  1. Shipping time
Estimated delivery times are shown at checkout or on the product page. These are estimates, not guarantees. Delays can occur. We will inform you of known major delays.
  2. Shipping costs
Calculated at checkout, depending on destination, weight, size, or carrier.
  3. Risk and title
Risk of loss or damage transfers to you when the product is delivered. Title transfers to you upon full payment.
  4. Failed delivery
If delivery fails due to incorrect address or failure to collect, we may charge additional shipping or storage fees, or cancel the order and refund after deductions.

6. Right of withdrawal and returns

This section applies to consumers in the EU. If you are buying as a business, your rights may differ.

  1. Right of withdrawal
You have the right to cancel your order within 14 calendar days without giving any reason. The period starts:
    • For goods: from the day you receive the goods.
  2. How to exercise
To cancel, inform us clearly by using the contact form on our Contact Us-page, with your order details before the 14‑day period ends.
  3. Effects of withdrawal
    After cancellation:
    • We will refund all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the date we receive notice of cancellation.
    • You must return the goods within 14 days of telling us you cancel. You bear direct costs of returning the goods, unless we stated otherwise.
    • Goods must be returned in the same condition, unused, with original packaging where possible. You are only liable for any diminished value due to handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  4. Exceptions
Certain items may be excluded from the right of withdrawal where EU rules allow, such as personalized goods or items that are clearly made to order. Where an item is excluded, this will be stated clearly before you place the order.

7. Defective goods, conformity and warranty

  1. Legal warranty and conformity
Goods must be in conformity with the contract, meet usual quality standards, and be fit for normal use. If a product is defective or not as described, you have rights under EU consumer law, which may include repair, replacement, price reduction, or refund depending on the situation.
  2. Reporting defects
Contact us as soon as possible at info@borderstride.com with order details and a description of the issue. Provide photos if possible.
  3. Evidence of defect
You may be asked to return the item for inspection. We will cover reasonable costs if the item is confirmed defective.
  4. Limitations
We are not liable for defects resulting from misuse, improper care, accidents, or modifications not authorized by us.

8. Product safety and compliance

  1. Commitment to safe products
We work with carefully selected suppliers and production partners to ensure products meet safety, quality, and material standards suitable for normal and foreseeable use. This includes providing clear care and safety information where relevant.
  2. Traceability and corrective measures
We retain order and production records to trace products, respond to safety issues, and take corrective measures if necessary.
  3. Applicable regulations
We acknowledge EU product safety rules. The EU has updated its legal framework for general product safety through Regulation (EU) 2023/988, which replaces previous rules. This underlines the importance of ensuring safe consumer goods. eur-lex.europa.eu
Our practices aim to reflect the spirit of such requirements, though the formal compliance depends on product type, supplier documentation, and specific risk.

9. Limitation of liability

  1. General limitation
Except for death or personal injury caused by our negligence, or where liability cannot be excluded by applicable law, our total liability is limited to the amount you paid for the product giving rise to the claim.
  2. Indirect or consequential loss
We are not liable for indirect, incidental, or consequential losses such as lost profits, business interruption, or loss of data.
  3. Third‑party services or suppliers
We may use third‑party suppliers for production, fulfillment, shipping, or other services. We try to choose reliable partners and set clear requirements. However, we are not responsible for failures of those third parties beyond what EU law allows.

All content, graphics, logos, and designs on the website are owned or licensed by Borderstride Morrow or its partners. You may not copy, reproduce, distribute, or create derivative works without permission, except where strictly required to use the product purchased.

13. Governing law and jurisdiction

  1. Applicable law
These terms are governed by the laws of Belgium and applicable EU law, without regard to conflict of law principles.
  2. Dispute resolution
Where possible, disputes should be resolved by direct communication. For consumers, mandatory EU or national consumer protection rules may grant additional rights.

Any legal claim or action arising from or relating to these terms shall be brought in the courts of Belgium, unless mandatory law requires otherwise.
